You may well be right.  If there was no attempt to get the woman fitted properly and/or if there was no instruction given, there may be a valid (possibly criminal) negligence charge here.  On the other hand, I have been in the position of trying to get people to obey such regulations.  Some people just insist on loosening their vest or they fail to buckle their helmet.  As a guide, you need to be on the lookout.  It is easy to spot someone who has unbuckled their vest but if they have just loosened it, that is pretty hard to spot.

The river is very strong and it can remove even a properly fitted PFD.  But this incident sounds to me like a good case of the guide or the victim not having enough respect for the river.
