I also highly doubt that you are required to talk to the police without a lawyer present just because you get a subpoena. In most jurisdictions that I am aware of, you cannot be subpoenaed in a criminal case except to appear in court. What that means is that the police or DA CANNOT FORCE YOU to talk just because they deliver a subpoena, at least until you are on the stand.

This is very different than a civil context, but I would find it simply incredible that someone who was being deposed could not bring their own attorney in a civil context. Do you have any authority for that proposition?
