He also escalated the situation by getting out of his car in the first place.
It isn't his place to be questioning anyone who is walking down the street talking on their cell phone.
So yes, you are correct that if he was simply punched first, then he may possibly be justified in using his gun in self defense, but his prior actions to the assault, all contributed to it.
If he simply calls it in, and does nothing else but follow the instructions of the 911 operator, then none of this happens.
