In a thread at the time, a legal eagle pointed out that a mall is a semi-public entity. If they allow people to walk around with "Bomb Saddamb!" t-shirts, they may be infringing on his free-speech rights if they arrested a person who was simply wearing a Peace t-shirt.

The complaint asserts that he was bothering other shoppers. That remains unproven. The mall dropped the charges, in part because of public protests against their outrageous behavior.
